-vehicle accident early this morning which killed the lone passenger cowboys teammate jerry brown, a member of the practice squad. irving, texas police spokesman had this to say early today. >> mr. price brent was asked to perform some field sobriety tests. after he performed those field sobriety tests based on his performance of those tests along with our officers' observations and the conversations that they had with him, he was placed under arrest for driving while intoxicated. once our officers learned that mr. brown had passed away then mr. price brent was under arrest for intoxication manslaughter. >> tim: brent and brown were teammates at the university of illinois. brent was suspended from the illini team in 2009 after a d.u.i. arrest. he was sentenced to 60 days in jail. 200 hours of community service and two years probation for that offense. his current charge is a second-degree felony punishable by two to 20 years of imprisonment and a fine of up to $10,000. by elizabeth warren in his bid for re-election, that scott brown will be the republican nominee. that special election i think is scheduled for around june of this year and there's already been a few democratic potential candidates who are thinking of challenging scott brown assuming scott brown runs for that senate seat, whether deval patrick, the governor of massachusetts, congressman ed markey, the long serving democratic congressman from massachusetts. there's been some other names mentioned as well, but it's going to have a political fallout as well as international fallout, but the bottom line is the president has decided to nominate john kerry as the next secretary of state. >> it is interesting, too, that the republican scott brown came out for gun control legislation, some form of gurn control legislation, which we have not heard from many sitting republicans. >> scott brown's position has evolved since the fallout a week ago of what happened in newtown, connecticut. he favored an assault weapons ban if done by states. he didn't think the federal government should get involved, but n

when the court declared in brown versus board of education that separate was not in fact equal. and in 1973 when roe v wade was decided, abortion was legal in only four states. given the court's historic inclination to favor expansion of freedoms, even when public opinion is not on its side, it would seem plausible the justices will conform what a majority believe is right and up hold the constitutionality of marriage equality. if this is in fact the result, president obama will guide one of the last remaining civil rights battles to completion. a moment that may come to define his presidency as much as anything he has done to date. similarly on the subject of immigration, president obama has made clear that comprehensive immigration reform will happen in the next four years. stung by rue milluating losses at the polls in november, the gop understands the problems its faces among the young, the brown and the young and brown. the only question is just how long it takes the republican party to come to terms with this. if conservatives are smart they will try to find a seat at the
